New Legislation (Health and Safety (Offences)) Act 2008
This came into force on the 16th of January 2009, it amends the original Heath and Safety at Work Act 1974.
The new act puts the ball in the fleet decision makers court - usually fleet mangers or company directors. It could mean up to two years imprisonment, if convicted. It could be used to prosecute if a crash results from poor management of Health and Safety at Work like poor vehicle maintenance, or an employee forced to drive after long periods of work.
Legislation
- The Management of Health and Safety at Work Regulations 1999
Requires all employers to carry out risk assessments on employees activities. - Health and Safety at work Act 1974
Requires employers to ensure, so far as is reasonably practicable, the health and safety of all employees while at work. - Health and Safety (Offences) Act 2008
Increases the penalties for non compliance with health and safety at work, and puts the responsibility on the business. - Corporate Manslaughter and Corporate Homicide Act 2007
Provides the ability to prosecute the corporate body and individuals in certain circumstances for heath and safety offence.
